The EFTA Court is a supranational judicial body based in Luxembourg that ensures judicial oversight of the European Economic Area (EEA) Agreement in Iceland, Liechtenstein, and Norway. It plays a crucial role in Iceland by interpreting EEA rules and handling cases where the EFTA Surveillance Authority (ESA) alleges that Iceland has failed to meet its obligations under the EEA Agreement. For example, the EFTA Court recently ruled that searches conducted by the ESA at Toska ehf. (which operates Lyf og heilsa) and SKEL fjárfestingafélag hf. were lawful, in connection with an investigation into alleged competition infringements in the retail pharmaceutical market in Iceland.
